  • This seminar explores the concepts of existing use right and ancillary uses.  Whilst existing use rights and ancillary uses are distinct legal concepts, in practice there is often an overlap between the two.  This seminar will look at the bases, application, extent of existing use right, while also examining the concept of ancillary uses having regard to the 'real and substancial purpose' test.  It will also discuss a range of VCAT and other court decisions, together with current topical examples.

Charter of Human Rights & Responsibilities 

On 1 January 2007 the Victorian Charter of Human Rights and Responsibilities commenced operation. In 2007 all legislation introduced into Parliament must include a statement of compatibility. From 2008 public authorities, local government and Victoria Police must comply with the charter.
