Kathryn is a specialist in Property Law, practising in property development, and commercial property transactions. Kathryn has more than 16 years experience acting for property developers in relation to broad acre and medium density developments, including providing specialist owners corporations advice. She also acts in relation to sales, purchases and the development of commercial and rural properties, retirement villages and aged care facilities. Kathryn was recognised by Best Lawyers 2014 - 2018 for expertise in Retirement Villages and Senior Living Law.

Experience

  • All aspects of commercial property law including sales and acquisitions, subdivisions and property development
  • Retirement villages and aged care facilities, including sales and purchases of existing facilities and development sites, development advice, resident contract preparation, management advice and dispute resolution
  • Advising corporate, private and not-for-profit operators on compliance with retirement living law, including engagement with State Government in relation to the current reforms to the Retirement Villages Act 1986 (Vic)
  • Acting for Australand’s residential division, managing broadacre and built form developments in Victoria. This includes preparing all sale contracts, preparing and negotiating planning and infrastructure agreements, advising on disputes, advising and preparing applications concerning the Growth Areas Infrastructure Contributions
  • Acting in all matters relating to mortgage sales for major trading banks and private clients
  • Providing owners corporation advice to developers, retirement village operators and mortgagees
  • Dealings with contaminated land including investigations with the Environment Protection Authority, advice to client and drafting contamination special conditions
  • Sales of landlocked parcels of land including dealings with local Councils and government departments regarding access licenses and drafting appropriate special conditions
  • Dealings with encumbrances registered on title including warrants, caveats, notices of action, second mortgages (and priority agreements), all dealings with the Land Registry regarding such encumbrances, advice to client regarding encumbrances
  • Sales of owner built properties including advice regarding the Building Act, dealing with builders warranty insurance, applications for insurance
  • Old law conveyancing and title conversions, adverse possession applications
