Abbey is an active member of the Russell Kennedy Workplace Relations, Employment and Safety team. She assists clients in all aspects of employment law including advising on employment obligations, equal opportunity, application of awards, interpretation of enterprise agreements and termination of employment. Abbey has sound experience in drafting employment agreements, workplace policies and enterprise agreements. She also assists clients to avoid disputes by providing strategic advice. Abbey has experience representing clients in unfair dismissal and general protections matters at the Fair Work Commission and has assisted with employment-related litigation in the state and federal courts.

Experience

  • Drafting, negotiating and advising on employment contracts, independent contractor agreements and policies
  • Advising on disciplinary matters, redundancy processes and termination of employment and drafting related documents on behalf of clients
  • Advising on employment matters in the transfer of business and undertaking employment related due diligence
  • Representing clients in unfair dismissal and general protection proceedings including jurisdictional hearings in the Fair Work Commission
  • Running litigation in the state and the federal courts relating to breach of contract and breach of post-employment restraints
  • Advising on and negotiating enterprise agreements, assisting clients with the pre-approval process and the lodgement of enterprise agreements
  • Advising on the interaction between enterprise agreements, transitional awards, modern awards and the National Employment Standards
  • Assisting with workplace investigations into employee conduct including interviewing witnesses, drafting statements and providing advice on investigation reports
  • Assisting with the preparation for the representation of clients in equal opportunity matters including sexual harassment and discrimination claims
  • Advising clients in relation to obligations under workplace health and safety and discrimination legislation
  • Keeping clients up to date on changes to employment law through drafting alerts and giving presentations
