Workplace Relations, Employment & Safety

With our detailed knowledge and expertise, we provide specialist advice on all aspects of workplace relations, employment and safety. Our clients include government departments, statutory authorities and public and private companies.

We provide advice on contracts and policies, and assist our clients with managing performance, disciplinary issues, workplace investigations, long-term injuries, and organisational change.  We provide advice in relation to termination of employment, appearing regularly in unfair dismissal disputes and other matters before the Fair Work Commission.

We are experienced in the interpretation of enterprise agreements and awards, including the drafting, negotiation and lodgement of enterprise agreements.  We provide advice to clients regarding protected industrial action, good faith bargaining, and union right of entry, balancing a firm understanding of legal obligations against more practical considerations.

We have acted in relation to a range of workplace health and safety incidents, including defending clients from prosecutions by the Victorian WorkCover Authority.  We provide our clients with advice regarding responding to critical incidents, dealing with investigators, and compliance with statutory obligations. We also have substantial experience in successfully applying to set aside improvement notices and prohibition notices, both through the Victorian WorkCover Authority’s internal review process, and through VCAT.

We have extensive experience in the area of equal opportunity law, including anti-discrimination and sexual harassment. We advise our clients on a range of discrimination issues. We also regularly appear before the Australian Human Rights Commission, the Federal Courts, Victorian Equal Opportunity and Human Rights Commission and VCAT in relation to such actions.

We work closely with our clients to resolve complex issues and implement policies and procedures that are reflective of legal requirements, but also the realities of each business.
