Workplace Relations Seminar - Mental illness in the workplace: a focus on reasonable adjustments

An employee tells you they have been diagnosed with an anxiety disorder and that they need an environment without unnecessary stress and conflict. Do you know what to do? Are you able to manage the stress and conflict the employee faces in their role? Are you required to? What evidence do you have, or do you need, regarding the employee’s mental health?


We frequently find ourselves advising employers on questions around mental health issues in the workplace.  When an employee requests an alteration to their duties or hours, employers are often uncertain as to their legal obligations.  While some proposed adjustments area easily accommodated, others present significant practical challenges.

This seminar is aimed at helping employers to meet those challenges, using recent decisions to help clarify the legal position on reasonable adjustments.  Anthony Massaro and Abbey Burns will cover:

  • Obligations to make reasonable adjustments under discrimination laws applying in Victoria;
  • Return to work obligations in the WorkCover system
  • Dealing with medical evidence (theirs, and yours)
