RK Special Counsel Emma Turner, Lawyer Sophie Bolzonello and Lawyer Kate Vanrenen have had an article published in the Australian Health Law Bulletin titled 'An update on substitute decision making for participation in medical research'.

A recent NSW case and new legislation in the ACT highlight the importance of ensuring clinicians are aware of the substitute decision-making requirements to enable people with impaired decision-making capacity to participate in medical research.

The decision in the SPICE III trial case has confirmed that formal approval from the Tribunal is not required to enable the participation of adults with impaired capacity in medical research trials involving existing forms of treatment that receive support from a substantial number of medical practitioners specialising in the relevant field; even in circumstances where a drug is used outside its TGA approved product information.
