Commencement of New South Wales Strata Hub annual reporting requirements reminder

As of 30 June 2022, under amendments made by the New South Wales Government to the Strata Schemes Management Act 2015, strata schemes must file a return within 3 months of each annual general meeting and pay an annual fee of $3.00 per lot.

The information required includes, inter alia:

  • strata plan number for the strata scheme
  • the date of registration of the strata plan for the strata scheme
  • if the strata scheme is part of a community scheme – the date of registration and the number of the community plan
  • if the strata scheme is part of a precinct scheme – the date of registration and the number of the precinct plan
  • the address of the parcel of the strata scheme
  • the total number of lots in the strata scheme
  • the number of lots in the strata scheme used for the following purposes:
    1. residential purposes
    2. the purpose of a retirement village
    3. commercial purposes
    4. purposes of a utility lot; and/or
    5. other purpose
  • if the building of the strata scheme is a NABERS rating – the rating
  • if information or final Occupation Certificate has been issued under the Environmental Planning and Assessment Act 1979 for the building of the strata scheme – the date the certificate was issued
  • if an annual fire safety statement has been issued under the Environmental Planning and Assessment Act 1979 for the building – the date of the most recent statement
  • for a class 2 building within the meaning of the Building Code of Australia of the strata scheme – the number of storeys above ground level of the building
  • if the Owners Corporation is required to insure the building or part of the building of the strata scheme under the Act – the replacement value of the building or part of the building:
  • as specified in the damage policy for the building; or
  • determined by the Tribunal under the Act (Section 142 (3)); and
  • the following details of the Secretary of the owners corporation:
    1. full name
    2. telephone number
    3. email address
  • the following details of the Chairperson of the owners corporation:
    1. full name
    2. telephone number
    3. email address
  • if there is a Managing Agent appointed for the strata scheme – the following information:
    1. full name
    2. telephone number
    3. email address
    4. the name of the Agent, the Agent’s licence number under the Property and Stock Agents Act 2002
  • if there is a Building Manager appointed for the strata scheme – the following details of the Manager:
    1. full name
    2. telephone number
    3. email address
  • the following details of the Emergency Contact Person for the strata scheme:
    1. full name
    2. telephone number
    3. email address
    4. the person’s connection to the strata scheme, ie Secretary, Chairperson or other Officer of the owners corporation, the strata Managing Agent for the scheme, the Building Manager for the scheme or the owner/occupier of the lot in the scheme
  • the date of the most recent annual general meeting of the owners corporation
  • if the owners corporation is required to establish a capital works fund under the Act – the balance of the fund as specified in the most recent statements
  • whether the strata renewal committee is currently established under the Strata Schemes Development Act 2015 in relation to the strata scheme and if so – the date that the committee was established.

As the personal information required to be provided in relation to the Officers of the owners corporation is extensive, the owners of the strata lots may find it difficult to have owners nominate for the various management positions as their personal information will be available to anybody searching the Strata Hub.

All schemes will need to be registered on the Strata Hub by 30 September 2022.
